法学家阶层的产生和壮大，是一个社会政治昌明，经济繁荣的外在表征和必然结果。回顾法学家在中国和西方的不同历史境遇，除作为上述命题的明证之外，尤能令我辈油然而生“达则兼济天下”之豪情。当代法学家，应当不断突破物欲的羁绊，以其独立精神和理性正义推动法治国进程，同时实现作为一个社会阶层的自我价值。“上书”在古今中外的政治和法制方面都有积极意义，“孙志刚”案件中的法学家上书，为树立法治观念和开拓权利文化发挥了引领和示范作用，是法学家阶层在当代社会舞台上之经典演绎。

The jurisconsults’ Submission Caused by the Case of Zhigang-Sun
——The Actions of Jurisconsults in the Development of Law

Abstract:
The naissance and growth of jurisconsults’ stratum, is an external token and inevitable outcome of the flourishing politics and the prosperous economic of a society. Reviewing jurist’s different historical circumstances in China and the west, besides regarding as the clear proof of above-mentioned propositions, we rise of itself the lofty sentiments of“to be success and hold concurrently to help the world”. Contemporary jurists, should break through fetters of material desires constantly, promote the process of rule by law with independent spirit and rational justice, and realize themselves as the self-value of a social stratum at the same time. “ Submission” was significant in political and legal system at all times and in all lands. This time, different from the formers, the jurisconsults have played a leading and exemplary role in the establishment of the idea of rule by law and the right culture. It is their classical performance on the contemporary social stage.

如果这是个缤纷的年代，鲜红的血色不知会不会构成不和谐的一抹。一个最最平凡的生命，偶然间注定要成为中国法治化一个里程的表征：因为伴随这个年轻生命陨落的，是饱受争议却实施二十年之久的《城市流浪乞讨人员收容遣送办法》的废止，和《城市生活无着的流浪乞讨人员救助管理办法》的诞生。
